These Terms of Service ("Terms") govern your access to and use of the review management platform and website at https://reviews5star.com (the "Service"), operated by Reviews5Star ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

Who these Terms apply to: business account holders ("you", "Subscriber") who register to use the platform. If you are a customer submitting feedback through a business's review page, your submission is governed by that business's policies; our role is limited to processing and delivering that feedback to the business.

1. The Service

Reviews5Star provides review management tools for local businesses, including:

A customizable, branded review landing page for your business.
Feedback routing: customers who select a 5-star rating may be directed to a public review platform of your choice (such as Google); customers who select a lower rating are directed to a private feedback form.
A dashboard to monitor feedback and review activity.
Tools such as QR code generation, notifications, and CRM features.

We may update, improve, or change features of the Service over time. If a change materially reduces core functionality, we will notify you by email.

2. Accounts

You must provide accurate and complete information when creating your account.
You are responsible for keeping your password secure and for all activity that occurs under your account.
Each account is intended for one business. Managing multiple businesses requires separate accounts.
You must be at least 18 years old and legally able to enter into a binding contract to create an account.

3. Free Trial, Billing, and Cancellation

Free trial

New accounts may be offered a 3-day free trial. Trial terms are presented at signup. If you do not cancel before the trial ends, your subscription automatically converts to a paid monthly subscription and your payment method on file will be charged.

Billing

The subscription price is $77 USD per month (the "Professional Plan"), unless otherwise agreed in writing.
Subscriptions renew automatically each month until cancelled.
All payments are processed securely by Stripe. We do not store your full credit card details.
Prices are in USD and may be changed with at least 30 days' notice before your next billing date.

Cancellation

You may cancel your subscription at any time. Cancellation stops future charges.
Cancelling takes effect at the end of your current billing period. You keep access until then.
Payments already made are non-refundable, including the first charge after a trial ends, unless we state otherwise in writing or where required by law.

Late or failed payments

If a payment fails, we may retry the charge, restrict access to the Service, and/or suspend the account until the balance is resolved. Repeated failures may result in termination.

4. Acceptable Use

You agree NOT to use the Service to:

Create, fabricate, purchase, or incentivize fake reviews.
Impersonate any person or business, or misrepresent your identity or affiliation.
Harass, threaten, or unlawfully discriminate against customers who leave feedback.
Submit or distribute malware, spam, or content that violates any law or third-party right.
Attempt to access, scrape, or disrupt the Service or other accounts, or reverse-engineer the platform.
Use the Service in any manner that violates applicable laws, including consumer protection, privacy, and advertising laws.

Responsibility for review platform policies: Third-party platforms such as Google, Facebook, and Yelp have their own rules about reviews and how businesses solicit them. You are solely responsible for ensuring that your use of the Service complies with those platforms' policies, as well as with any laws that apply to your business and location. We provide tools; we do not control third-party platforms and cannot guarantee that reviews submitted to them will be published, ranked, or retained.

5. Customer Feedback Data

Feedback submitted through your review pages (including private feedback) is provided to you for managing your business and customer relationships.
You are responsible for handling that data in compliance with applicable privacy laws (such as GDPR or CCPA where relevant) and for honoring data deletion requests from your customers.
We may process feedback data as described in our Privacy Policy.

6. Intellectual Property

The Service — including its software, design, text, graphics, and branding — is owned by Reviews5Star and protected by intellectual property laws. You may not copy, modify, or redistribute it without written permission.
Your content: you retain ownership of your business name, logo, and branding materials you upload. You grant us a limited license to use and display them solely to operate the Service for you (for example, rendering your branded review page).
Feedback you send us: if you send us suggestions or feature ideas, you grant us a perpetual, royalty-free right to use them to improve the Service, without obligation to you.

7. Third-Party Services

The Service integrates with and redirects to third-party services — including Stripe (payments), Google, Facebook, Yelp, and email/SMS delivery providers. These services are governed by their own terms and policies. We are not responsible for their availability, actions, or content, and we may adjust integrations as those services evolve.

8. Service Availability

We work to keep the Service available and functional, but we do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, or events beyond our reasonable control may cause temporary unavailability.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will result in any specific number of reviews, rankings, or business outcomes.

10. Limitation of Liability

To the maximum extent permitted by law:

Reviews5Star shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Reviews5Star and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right or applicable law; or (d) your handling of customer feedback data.

12. Suspension and Termination

By you: you may cancel anytime as described in Section 3.
By us: we may suspend or terminate your account immediately if you materially breach these Terms (for example, using the Service for fake reviews or fraud), fail to pay, or create legal risk for us. Where practicable, we will notify you by email.
Upon termination, your access ends. We may retain data for up to 90 days, after which it is deleted, as described in our Privacy Policy.

13. Changes to These Terms

We may modify these Terms from time to time. If a change is material, we will notify account holders by email at least 14 days before it takes effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the State in which the operator of the Service is established, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction, unless applicable law provides otherwise.
